class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Seg\u00fan el numeral 15 de la Ley Federal del Trabajo (LFT), los\u00a0<strong>prestadores de servicios especializados u obras especializadas<\/strong>\u00a0deben contar con un registro ante la\u00a0<strong>Secretar\u00eda del Trabajo y Previsi\u00f3n Social (STPS)<\/strong>.<\/p><p>Dicho registro debe renovarse cada tres a\u00f1os, contados a partir de la fecha en que la empresa hubiese quedado inscrita en el padr\u00f3n, a trav\u00e9s del portal de \u201c<strong>Registro de Prestadores de Servicios Especializados u Obras Especializadas<\/strong>\u201d \u2014<strong>REPSE<\/strong>\u2014 (arts. 15, segundo p\u00e1rrafo, LFT y d\u00e9cimo tercero,\u00a0<em>que Acuerdo que modifica el diverso por el que se dan a conocer las disposiciones de car\u00e1cter general para el registro de personas f\u00edsicas o morales que presten servicios especializados o ejecuten obras especializadas a que se refiere el art\u00edculo 15 de la LFT<\/em>\u00a0\u2014Acuerdo REPSE\u2014).<\/p><p>Esto ha generado inquietud en el sector empresarial, al preguntarse si la consecuencia de no realizar este tr\u00e1mite implica la imposici\u00f3n de una\u00a0<strong>multa<\/strong>.<\/p><p>Por ello,\u00a0debe quedar claro que al no renovarse el\u00a0<strong>registro en el REPSE<\/strong>, la\u00a0<strong>STPS<\/strong>\u00a0lo cancelar\u00e1, por lo que, los patrones deber\u00e1n realizar una nueva inscripci\u00f3n en el padr\u00f3n, sin que medie alguna sanci\u00f3n por ello (art. d\u00e9cimo sexto, pen\u00faltimo p\u00e1rrafo, Acuerdo REPSE).<\/p><h3 class=\"cms-megaMenus-H3\"><strong>\u00bfCu\u00e1ndo proceder\u00eda una multa por no contar con el REPSE vigente?<\/strong><\/h3><p>Si a pesar de la\u00a0<strong>cancelaci\u00f3n del REPSE<\/strong>\u00a0los empresarios contin\u00faan brindando\u00a0<strong>servicios especializados<\/strong>, corren el riesgo de ser sancionados en t\u00e9rminos del numeral 1004-C de la LFT; esto es, con una multa que va de 2,000 a 50,000 veces la Unidad de Medida y Actualizaci\u00f3n (UMA) \u2014actualmente de $ 217,140.00 a $ 5\u2019428,500.00\u2014.<\/p><p>Los supuestos en que los\u00a0<strong>empleadores<\/strong>\u00a0pueden ser sancionados son:<\/p><ul><li aria-level=\"1\">prestar\u00a0<strong>servicios de subcontrataci\u00f3n especializada<\/strong>\u00a0sin contar con el registro ante\u00a0<strong>REPSE<\/strong>, y<\/li><li aria-level=\"1\">beneficiarse de los servicios de un contratista que no est\u00e9 registrado ante la\u00a0<strong>STPS<\/strong>\u00a0<\/li><\/ul><p>Por ello,\u00a0los patrones deben revisar si est\u00e1n en tiempo de renovar su registro, o en caso de contar con\u00a0<strong>proveedores especializados<\/strong>, verificar que estos cuenten con su\u00a0<strong>REPSE<\/strong>\u00a0vigente.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div
