class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La\u00a0<strong>participaci\u00f3n de los trabajadores en el reparto de utilidades (PTU)<\/strong>\u00a0es un derecho establecido en el art\u00edculo 123 de nuestra carta magna. Tiene como prop\u00f3sito generar conciencia y compromiso en los\u00a0<strong>trabajadores\u00a0<\/strong>mexicanos en la b\u00fasqueda del incremento de la productividad en el territorio nacional.<\/p><p>Con la\u00a0<strong>PTU,<\/strong>\u00a0los\u00a0<strong>empleados<\/strong>\u00a0reciben un beneficio econ\u00f3mico directo y proporcional al resultado financiero de la\u00a0<strong>empresa<\/strong>\u00a0o el\u00a0<strong>centro de trabajo<\/strong>\u00a0en el que prestan sus servicios.\u00a0<\/p><h3 class=\"cms-megaMenus-H3\"><strong>Impacto del reparto de utilidades en los trabajadores<\/strong><\/h3><p>Se presume que el efecto psicol\u00f3gico que tiene la\u00a0<strong>entrega de PTU<\/strong>\u00a0en cada\u00a0<strong>trabajador<\/strong>\u00a0es el deseo de\u00a0<strong>incrementar las utilidades<\/strong>, pues esto le reportar\u00e1 un beneficio directo; si en la colectividad, los\u00a0<strong>trabajadores<\/strong>\u00a0tienen esa misma idea, la eficacia y eficiencia en la realizaci\u00f3n de sus tareas repercutir\u00e1 positivamente en la\u00a0<strong>productividad<\/strong>\u00a0de ese\u00a0<strong>centro de trabajo<\/strong>\u00a0o\u00a0<strong>unidad econ\u00f3mica<\/strong>, y en el consecuente\u00a0<strong>aumento en las utilidades<\/strong>.<\/p><p>Si esta f\u00f3rmula se replica en cada\u00a0<strong>centro de trabajo<\/strong>, industria, sector y zona geogr\u00e1fica del pa\u00eds, habr\u00e1 una mayor productividad nacional.\u00a0<\/p><p>Todo esto se explica respondiendo la\u00a0 interrogante constante, de \u00bfPor qu\u00e9 se deben repartir\u00a0<strong>utilidades<\/strong>\u00a0a los trabajadores, adicional al salario que perciben?, y no conformarnos con la respuesta de \u201cPorque as\u00ed lo establece la ley\u201d.<\/p><h3 class=\"cms-megaMenus-H3\"><strong>Aspectos a cuidar en el reparto de utilidades<\/strong><\/h3><p>En el art\u00edculo 123, fracci\u00f3n IX de la Constituci\u00f3n de los Estados Unidos Mexicanos\u00a0 se prev\u00e9 que los\u00a0<strong>trabajadores<\/strong>\u00a0tienen derecho a una\u00a0<strong>participaci\u00f3n en las utilidades de las empresas<\/strong>. Adem\u00e1s contempla el establecimiento de una Comisi\u00f3n Nacional tripartita encargada de realizar los estudios necesarios para conocer las condiciones de la econom\u00eda nacional, y as\u00ed definir el porcentaje de\u00a0<strong>utilidades a repartir<\/strong>\u00a0a los\u00a0<strong>empleados<\/strong>.\u00a0<\/p><p>Por su parte, en la Ley Federal del Trabajo (LFT) -como ley reglamentaria- se ubica la regulaci\u00f3n de este derecho, en donde adicionalmente se se\u00f1ala que el\u00a0<strong>reparto de utilidades<\/strong>\u00a0entre los\u00a0<strong>trabajadores<\/strong>\u00a0debe efectuarse dentro de los 60 d\u00edas siguientes a la fecha en que deba pagarse el\u00a0<strong>impuesto anual<\/strong>.<\/p><p>Tambi\u00e9n indica que la\u00a0<strong>utilidad repartible<\/strong>\u00a0se dividir\u00e1 en dos partes iguales: la primera se repartir\u00e1 por igual entre todos los\u00a0<strong>trabajadores<\/strong>, considerando el\u00a0<strong>n\u00famero de d\u00edas trabajados<\/strong>\u00a0por cada uno en el a\u00f1o, independientemente del monto de los\u00a0<strong>salarios<\/strong>; y la segunda, en proporci\u00f3n al monto de los\u00a0<strong>salarios devengados<\/strong>\u00a0por el trabajo prestado durante el a\u00f1o, entendi\u00e9ndose como\u00a0<strong>salario<\/strong>\u00a0la cantidad por\u00a0<strong>cuota diaria\u00a0<\/strong>percibida por cada\u00a0<strong>trabajador<\/strong>.<\/p><p>Para efectos del\u00a0<strong>c\u00e1lculo del reparto de las utilidades<\/strong>\u00a0entre los\u00a0<strong>trabajadores<\/strong>, debe integrarse una\u00a0<strong>comisi\u00f3n mixta<\/strong>\u00a0con igual n\u00famero de representantes tanto del\u00a0<strong>empleador<\/strong>\u00a0como de los\u00a0<strong>trabajadores.<\/strong><\/p><p>Vale la pena mencionar que el porcentaje establecido por la\u00a0<strong>Comisi\u00f3n Nacional para la Participaci\u00f3n de los Trabajadores en las Utilidades de las Empresas<\/strong>\u00a0es del 10% sobre las\u00a0<strong>utilidades<\/strong>\u00a0generadas por la\u00a0<strong>empresa\u00a0<\/strong>de que se trate en el ejercicio fiscal anterior, debi\u00e9ndose pagar en t\u00e9rminos generales a m\u00e1s tardar el 30 de mayo del siguiente al a\u00f1o objeto de reparto.<\/p><p>La LFT, en su art\u00edculo 126, precisa qu\u00e9 empresas que no est\u00e1n obligadas al\u00a0<strong>reparto de utilidades<\/strong>, entre las que se encuentran:<\/p><ul><li aria-level=\"1\">empresas de nueva creaci\u00f3n, durante el primer a\u00f1o de funcionamiento<\/li><li aria-level=\"1\">empresas de nueva creaci\u00f3n, dedicadas a la elaboraci\u00f3n de un producto nuevo, durante los dos primeros a\u00f1os de funcionamiento<\/li><li aria-level=\"1\">empresas de industria extractiva, de nueva creaci\u00f3n, durante el periodo de exploraci\u00f3n<\/li><li aria-level=\"1\">instituciones de asistencia privada, reconocidas por las leyes, que con bienes de propiedad particular ejecuten actos con fines humanitarios de asistencia, y<\/li><li aria-level=\"1\">empresas que tengan un capital menor del que fije la Secretar\u00eda del Trabajo y Previsi\u00f3n Social por ramas de la industria, previa consulta con la Secretar\u00eda de Econom\u00eda (actualmente, las que con su capital y trabajo generen un ingreso declarado fiscalmente no superior de $ 300,000.00)<\/li><\/ul><p>Entre los\u00a0<strong>trabajadores\u00a0<\/strong>que se encuentran excluidos por la propia LFT de participar en el\u00a0<strong>reparto de utilidades<\/strong>\u00a0est\u00e1n:<\/p><ul><li aria-level=\"1\">directores, administradores y gerentes generales de las empresas\u00a0<\/li><li aria-level=\"1\">trabajadores dom\u00e9sticos\u00a0<\/li><li aria-level=\"1\">personas f\u00edsicas que sean propietarias o copropietarias de una negociaci\u00f3n<\/li><li aria-level=\"1\">profesionales, t\u00e9cnicos, artesanos y otros que en forma independiente presten servicios a una empresa, siempre y cuando no exista una relaci\u00f3n de trabajo subordinada con el patr\u00f3n, y<\/li><li aria-level=\"1\">trabajadores eventuales cuando hayan laborado menos de 60 d\u00edas durante el ejercicio fiscal<\/li><\/ul><p>Es importante comentar que en el 2020 se reform\u00f3 la LFT en materia de r<strong>eparto de PTU,<\/strong>\u00a0en donde se estableci\u00f3 como tope m\u00e1ximo el de tres meses de salario ordinario o el promedio del pago recibido en los \u00faltimos tres a\u00f1os, la cantidad m\u00e1s alta es la que debe recibir el\u00a0<strong>trabajador<\/strong>.\u00a0<\/p><p>De igual forma,\u00a0se debe mencionar que la Ley del Impuesto sobre la Renta (LISR) considera el\u00a0<strong>reparto de utilidades<\/strong>\u00a0disminuible del resultado fiscal de que se trate;\u00a0y para el trabajador est\u00e1 exento hasta el importe de 15 veces la UMA.\u00a0<\/p><p>Conforme a la Ley del Seguro Social (LSS), las cantidades entregadas por concepto de PTU a los trabajadores no forma parte del salario base de cotizaci\u00f3n, siempre y cuando se observen los par\u00e1metros de la LFT para el reparto; de lo contrario, integrar\u00edan al mismo.<\/p><h3 class=\"cms-megaMenus-H3\"><strong>Conclusi\u00f3n<\/strong>\u00a0<\/h3><p>Como se observa el reparto de utilidades para los trabajadores tiene como fundamento legal en principio la Constituci\u00f3n, pero deber\u00e1 considerarse, por lo menos, lo previsto en la LFT, la LISR y la LSS para tener cubierto todo el aspecto legal del pago de esta prestaci\u00f3n, mismo que de la cual hemos procurado explicar su motivo principal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ff6531a elementor-post-navigation-borders-yes elementor-widget
