class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p dir=\"ltr\">No es nuevo hablar de los puntos m\u00e1s importantes del cambio de modelo que est\u00e1n experimentando las\u00a0<b>relaciones laborales<\/b>\u00a0en nuestro pa\u00eds, y de forma muy particular las colectivas de trabajo.<\/p><p dir=\"ltr\">En toda\u00a0<b>relaci\u00f3n colectiva<\/b>, los sujetos que la componen son, por un lado, el\u00a0<b>empleador<\/b>, y por otro, un\u00a0<b>sindicato<\/b>\u00a0en\u00a0<b>representaci\u00f3n de los trabajadores<\/b>\u00a0de determinado centro de trabajo.\u00a0<\/p><p dir=\"ltr\">Como se aprecia en este v\u00ednculo que en esencia debe ser bipartita, al configurarse es de car\u00e1cter tripartita.<\/p><p dir=\"ltr\">A esta figura tripartita se refieren los mecanismos implementados en la\u00a0<b>reforma laboral<\/b>, ya que si bien es cierto por su propia naturaleza, los\u00a0<b>sindicatos<\/b>\u00a0est\u00e1n integrados por los propios\u00a0<b>trabajadores<\/b>\u00a0de los\u00a0<b>centros de trabajo<\/b>, tambi\u00e9n lo es que tanto los\u00a0<b>empleadores\u00a0<\/b>como los\u00a0<b>sindicatos<\/b>, como resultado de diversos factores como la extorsi\u00f3n de algunos\u00a0<b>pseudo sindicatos<\/b>, decidieron cuidar los centros de trabajo y descuidaron su tarea principal: la\u00a0<b>representaci\u00f3n de los empleados<\/b>, con lo que se gener\u00f3 un abandono de estos \u00faltimos.<\/p><p dir=\"ltr\">Es as\u00ed, que actualmente la legislaci\u00f3n exige a los<a class=\"\" href=\"https:\/\/idconline.mx\/laboral\/2023\/09\/06\/personal-de-outsourcing-participa-en-conflicto-sindical-de-beneficiario\" target=\"_blank\" rel=\"noopener\" data-cms-id=\"0000018a-6785-d712-afab-6fe738b10000\" data-cms-href=\"https:\/\/idconline.mx\/laboral\/2023\/09\/06\/personal-de-outsourcing-participa-en-conflicto-sindical-de-beneficiario\" data-cms-ai=\"0\">\u00a0<\/a><b>sindicatos\u00a0<\/b>acreditar que tienen representatividad;\u00a0es decir, que efectivamente cuentan con el apoyo de sus agremiados que representan.\u00a0<\/p><p dir=\"ltr\">Con ello se deja claro que los\u00a0<b>sindicatos<\/b>\u00a0y los\u00a0<b>trabajadores<\/b>\u00a0son figuras diferentes, quienes en conjunto con el empleador de que se trate, forman el tripartidismo referido.<\/p><p dir=\"ltr\"><b>Marco regulatorio de las relaciones colectivas\u00a0<\/b><\/p><p dir=\"ltr\">El fundamento del nuevo modelo de las\u00a0<b>relaciones colectivas de trabajo\u00a0<\/b>est\u00e1 en diversos ordenamientos, los cuales han sufrido ciertas modificaciones; a saber:<\/p><ul><li dir=\"ltr\" aria-level=\"1\"><p dir=\"ltr\" role=\"presentation\">art\u00edculo 123 constitucional reformado el 24 de febrero de 2017<\/p><\/li><li dir=\"ltr\" aria-level=\"1\"><p dir=\"ltr\" role=\"presentation\">convenio n\u00famero 98, Relativo a la aplicaci\u00f3n de los principios del Derecho de Sindicaci\u00f3n y de Negociaci\u00f3n Colectiva, de la Organizaci\u00f3n Internacional del Trabajo ratificado por M\u00e9xico el 23 de noviembre de 2018<\/p><\/li><li dir=\"ltr\" aria-level=\"1\"><p dir=\"ltr\" role=\"presentation\">Tratado comercial celebrado entre M\u00e9xico, Estados Unidos y Canad\u00e1 (<b>T-MEC<\/b>), espec\u00edficamente el Cap\u00edtulo 23, instrumento que entr\u00f3 en vigor el 1o. de julio de 2020, y\u00a0<\/p><\/li><li dir=\"ltr\" aria-level=\"1\"><p dir=\"ltr\" role=\"presentation\">Ley Federal del Trabajo (<b>LFT<\/b>) reformada el 1o. de mayo de 2019<\/p><\/li><\/ul><p dir=\"ltr\">Estos cambios en conjunto buscan garantizar que la\u00a0<b>representaci\u00f3n sindical\u00a0<\/b>sea efectiva para los\u00a0<b>trabajadores<\/b>, y de esta manera, mejoren sus condiciones econ\u00f3mico-sociales de estos.<\/p><p dir=\"ltr\">Esto significa que, por medio de esta serie de modificaciones normativas, as\u00ed como con los acuerdos de car\u00e1cter internacional firmados por nuestro pa\u00eds, se pretende cambiar el modelo laboral de manera gradual, el cual b\u00e1sicamente se concreta con los cinco pasos siguientes.<\/p><p dir=\"ltr\"><b>Paso uno, definici\u00f3n de proceso de elecci\u00f3n de estatutos sindicales<\/b><\/p><p dir=\"ltr\"><b>En la reforma laboral del 1o. de mayo de 2019,\u00a0<\/b>en el art\u00edculo 371, fracci\u00f3n IX de la LFT se establece que los\u00a0<b>estatutos de las organizaciones sindicales\u00a0<\/b>deben contener el\u00a0<b>proceso de elecci\u00f3n de las directivas sindicales<\/b>; es decir, las normas y los pasos a seguir para garantizar que ese proceso sea por la v\u00eda del voto personal, libre, directo y secreto.<\/p><p dir=\"ltr\">Para tal implementaci\u00f3n se concedi\u00f3 un plazo de ocho meses, el cual culmin\u00f3 el 1o. de enero de 2020; por consiguiente, aquellos sindicatos que no modificaron sus estatutos para acreditar el cumplimiento de esta obligaci\u00f3n, se vieron impedidos para\u00a0<b>depositar sus contratos colectivos de trabajo o presentar emplazamientos a huelga.<\/b><\/p><p dir=\"ltr\"><b>Paso dos, legitimaci\u00f3n de contratos colectivos de trabajo<\/b><\/p><p dir=\"ltr\">En el art\u00edculo decimoprimero de la reforma a la LFT de 2019,\u00a0 se previ\u00f3 el medio por el cual las\u00a0<b>organizaciones sindicales<\/b>\u00a0deber\u00edan de\u00a0<b>revisar sus contratos colectivos de trabajo (CCT)<\/b>, y por medio, del procedimiento definido\u00a0<b>someter a consulta el contenido de sus CCT con los trabajadores<\/b>, para que estos a su vez emitan un voto libre, directo y secreto con las mismas reglas del numeral 390 ter de la LFT.\u00a0<\/p><p dir=\"ltr\">De esta manera, se busca acreditar que estos contratos son conocidos y consentidos por sus representados-<\/p><p dir=\"ltr\">Inicialmente, esta medida se implement\u00f3 a trav\u00e9s de un\u00a0protocolo de legitimaci\u00f3n creado por la\u00a0<b>Secretar\u00eda del Trabajo y Previsi\u00f3n Social\u00a0<\/b>y concluido por el\u00a0<b>Centro Federal de Conciliaci\u00f3n y Registro Laboral (Cefecorel)<\/b>. Este proceso se contempl\u00f3 en los art\u00edculos transitorios de la reforma de 2019 y culmin\u00f3 este a\u00f1o.<\/p><p dir=\"ltr\"><i>La finalidad de esta legitimaci\u00f3n fue realizar una adecuada depuraci\u00f3n de los CCT efectivos y abiertos de los de protecci\u00f3n, que de acuerdo con las estad\u00edsticas oficiales, estos \u00faltimos representaban m\u00e1s del 85 % de la\u00a0<\/i><b><i>contrataci\u00f3n colectiva<\/i><\/b><i>\u00a0en M\u00e9xico.<\/i><\/p><p dir=\"ltr\"><b>Paso tres, comprobaci\u00f3n de que cuenta con el respaldo de los trabajadores<\/b><\/p><p dir=\"ltr\">El art\u00edculo 390 bis de la LFT se\u00f1ala que para que un\u00a0<b>sindicato<\/b>\u00a0pueda solicitar la\u00a0<b>celebraci\u00f3n de un CCT<\/b>, previamente debe de acreditar\u00a0 que cuenta por lo menos con el 30 % del respaldo de los\u00a0<b>trabajadores sindicalizables<\/b>\u00a0del centro de trabajo donde se pretende aplicar dicho contrato.\u00a0<\/p><p dir=\"ltr\">De acreditar este porcentaje ante el\u00a0<b>Cefecorel,<\/b>\u00a0<i>se le expedir\u00e1 al gremio sindical una\u00a0<\/i><b><i>constancia de representatividad<\/i><\/b><i>, con la que puede solicitar la\u00a0<b>celebraci\u00f3n de un CTT, o emplazar a huelga<\/b>\u00a0por firma del mismo.<\/i><\/p><p dir=\"ltr\">Se presume que esta medida tendr\u00e1 buenos resultados, porque como se sabe en el pasado la gran mayor\u00eda de los\u00a0<b>CCT\u00a0<\/b>no eran conocidos por los trabajadores a quienes aplicaba su clausulado.<\/p><p dir=\"ltr\"><b>Paso cuatro, consulta del CCT entre los trabajadores<\/b><\/p><p dir=\"ltr\">De acuerdo con el art\u00edculo 390 ter de la LFT, una vez que se tenga elaborado el proyecto del contenido del\u00a0<b>CCT<\/b>, los\u00a0<b>trabajadores del centro de trabajo<\/b>\u00a0donde se pretenda aplicar el mismo, deben votar a favor o en contra del contenido de este instrumento, por medio del\u00a0<b>voto libre directo y secreto.<\/b><\/p><p dir=\"ltr\">Y solamente si de la votaci\u00f3n se desprende que dicho CTT es respaldado por la mayor\u00eda de los trabajadores, este puede depositarse ante el Cefecorel y as\u00ed cobrar plena vigencia y validez.<\/p><p dir=\"ltr\"><b>Paso cinco, transparencia en el manejo sindical\u00a0<\/b><\/p><p dir=\"ltr\">En sus estatutos, toda organizaci\u00f3n sindical debe precisar las herramientas necesarias que garanticen la\u00a0<b>transparencia de los recursos provenientes de las cuotas de sus agremiados.\u00a0<\/b><\/p><p dir=\"ltr\">Para ello, el precepto 358, fracci\u00f3n IV de la LFT contempla que los agremiados tienen derecho a que sus\u00a0<b>organizaciones sindicales<\/b>\u00a0le den a conocer la manera en que son utilizadas las cuotas sindicales, as\u00ed como su destino.\u00a0<\/p><p dir=\"ltr\">Por su parte, el art\u00edculo 373 de la LFT indica que esta\u00a0<b>rendici\u00f3n de cuentas<\/b>\u00a0debe llevarse a cabo ante el\u00a0<b>Cefecorel<\/b>, para que se deposite y registre en el expediente de\u00a0<b>registro sindical<\/b>\u00a0correspondiente.\u00a0<\/p><p dir=\"ltr\">Este deber puede satisfacerse de manera electr\u00f3nica, o los propios agremiados pueden tramitar ante el tribunal laboral respectivo, el cumplimiento de esta exigencia, o denunciar ante el\u00a0<b>Cefecorel\u00a0<\/b>la omisi\u00f3n de proporcionar esta informaci\u00f3n.<\/p><p dir=\"ltr\"><b>Conclusi\u00f3n\u00a0<\/b><\/p><p dir=\"ltr\">Como se aprecia con la concreci\u00f3n de los cinco pasos previstos en la\u00a0<b>reforma laboral\u00a0<\/b>se pretende\u00a0<b>garantizar una efectiva representatividad de las organizaciones sindicales con los trabajadores<\/b>, as\u00ed como lograr que el trabajo que realizan los\u00a0<b>sindicatos<\/b>\u00a0se oriente plenamente a incrementar y mejorar las condiciones econ\u00f3mico-sociales de los trabajadores, y de esa manera encontrar un punto de fortalecimiento como competencia de nuestro pa\u00eds en la calidad de nuestros productos, as\u00ed como de su mano de obra y no en el pago de salarios bajos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div
