class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La NOM-037, emitida por la STPS, que tiene como objetivo regular las condiciones laborales de las personas que trabajan de forma remota o bajo la modalidad de teletrabajo es cada vez m\u00e1s necesaria ante el aumento del\u00a0<i>home office\u00a0<\/i>en el pa\u00eds.<\/p><p>De acuerdo con la Organizaci\u00f3n Internacional del Trabajo (OIT), previo a la pandemia el 3% de los colaboradores estaba en\u00a0<i>home office<\/i>, con la emergencia la cifra subi\u00f3 a 30%, en el caso de M\u00e9xico, el INEGI se\u00f1al\u00f3 que al cierre del segundo trimestre 2021 el 35.4% de la poblaci\u00f3n ocupada trabajaba desde su casa; la fecha 5.7% de las compa\u00f1\u00edas contempla mantener esta modalidad.<\/p><p>En ese sentido, el gerente de atracci\u00f3n de talento de ecosistemas, Ana Romano, comparti\u00f3 que la introducci\u00f3n de las tecnolog\u00edas de la Informaci\u00f3n y Comunicaci\u00f3n (TIC\u00b4s) en el pa\u00eds, generaron \u201cun cambio y modernizaci\u00f3n en los ambientes de trabajo; incrementando la eficiencia de los procesos y aumentando la rentabilidad de las compa\u00f1\u00edas\u201d.<\/p><p>De hecho, el trabajo remoto o\u00a0<i>home office\u00a0<\/i>se volvi\u00f3 clave en la atracci\u00f3n y retenci\u00f3n de talento pues en palabras de Romano, quienes \u201cno ofrezcan la posibilidad del Home Office sufrir\u00e1n la fuga de cerebros\u201d, entonces, sugiri\u00f3 adoptar dicho modelo, apeg\u00e1ndose a las disposiciones de la NOM-037, es decir, el empleador cumpla lo siguiente:<\/p><ul><li>proporcione a los teletrabajadores los recursos necesarios para llevar a cabo sus actividades (equipo de c\u00f3mputo, software, herramientas de trabajo y servicios de telecomunicaciones), y en la medida de lo posible equipo de trabajo f\u00edsico que ayuda a mejorar la calidad de vida durante el teletrabajo para salvaguardar la salud del personal<\/li><li>implementar medidas de seguridad y salud en el trabajo para garantizar condiciones \u00f3ptimas a los colaboradores como las que tienen quienes laboran en las instalaciones de la empresa<\/li><li>proporcionar informaci\u00f3n sobre los riesgos laborales asociados a esta forma de trabajo y medidas preventivas para evitarlos a fin de generar convenios empresariales con empresas del sector salud, donde los trabajadores remotos tengan acceso a revisiones de salud, charlas de prevenci\u00f3n de riesgos psicosociales, mentales, etc.<\/li><li>empleador y trabajador tienen que establecer acuerdos sobre las condiciones de trabajo, incluyendo horarios, tiempos de descanso, responsabilidades y plazos de entrega, generar un programa de comunicaci\u00f3n interna continua que aborde temas de inter\u00e9s como recomendaciones de trabajo remoto, gesti\u00f3n de tiempo, h\u00e1bitos saludables, ergonom\u00eda, prevenci\u00f3n y manejo de estr\u00e9s, adem\u00e1s de estilos de trabajo saludable<\/li><\/ul><p>Finalmente, las empresas tienen que considerar que el trabajador que realice teletrabajo tiene derecho a la misma remuneraci\u00f3n que si estuviera trabajando en las
