300;\">\u00a0<b><strong>Pre\u00e1mbulo<\/strong><\/b><\/p><p style=\"font-weight: 300;\">Los patrones al conocer las conductas que implican violaciones a la LFT,\u00a0 pueden evitar las causas que alteran el orden laboral, y as\u00ed incrementan su productividad y protegen su patrimonio al inhibir la imposici\u00f3n de sanciones por parte de la autoridad.<\/p><p style=\"font-weight: 300;\">De ah\u00ed que a continuaci\u00f3n se detallen el c\u00famulo de obligaciones a cumplir y las consecuencias econ\u00f3micas por su omisi\u00f3n.<\/p><p style=\"font-weight: 300;\">Para poder cuantificar las sanciones se toma como base el valor de la UMA, el cual fue publicado en el DOF el 10 de enero de 2020, en el cual el Instituto Nacional de Estad\u00edstica y Geograf\u00eda estableci\u00f3 que ese valor estar\u00e1 vigente a partir del\u00a0 1o. de febrero de 2020.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-a2b6d42 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"a2b6d42\" data-element_type=\"section\" style=\"font-weight: 300 !important;\" width=\"322\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">El contrato de trabajo es el documento que establece los t\u00e9rminos en los que se desarrollar\u00e1 una relaci\u00f3n laboral. Tanto patr\u00f3n como trabajador deben contar con una copia del mismo.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">\u00a0<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">El escrito en el que consten las condiciones de trabajo debe contener:<\/span><\/p><ul><li><span style=\"font-weight: 300 !important;\">\u00a0<\/span>tipo de contrato (tiempo determinado o indeterminado, obra determinada, capacitaci\u00f3n inicial o temporada).\u00a0<span style=\"font-weight: 300 !important;\">Si se trata de un pacto por lapso indefinido o definido mayor a 180 d\u00edas puede ser con la modalidad de periodo a prueba<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">lugar en el que se prestar\u00e1n los servicios<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">descripci\u00f3n de las actividades laborales<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">duraci\u00f3n de la jornada<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">monto del salario y las fechas de su pago<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">capacitaci\u00f3n y adiestramiento<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">actividades conexas, y<\/span><\/li><\/ul><ul><li>d\u00edas de descanso, vacaciones y otras prestaciones contractuales otorgadas, etc.<\/li><\/ul><\/td><td style=\"font-weight: 300 !important;\" width=\"131\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Multa de 50 a 5,000 veces la UMA (VUMA), esto es, de $ 4,344.00 a $ 434,400.00<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"219\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">La ventaja de contar con un contrato firmado por el colaborador es acreditar las condiciones con las que se contrat\u00f3 al trabajador y las que viene percibiendo.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">\u00a0<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Recomendaci\u00f3n:<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Es v\u00e1lido cambiar las condiciones contractuales al sucitarse una causa econ\u00f3mica que lo justifique.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">P<\/span><span style=\"font-weight: 300 !important;\">ara tal efecto, se debe firmar un convenio en el que se especifique que ambas partes est\u00e1n conformes con las modificaciones realizadas y ratificar ante la JCA\u00a0<\/span><span style=\"font-weight: 300 !important;\">competente, misma que deber\u00e1 dar fe del mismo y verificar que no existe violaci\u00f3n de derechos<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">\u00a0<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">(Arts. 26; 33, segundo p\u00e1rrafo, 34; 57; 784; 804, y 805, LFT)<\/span><\/p><\/td><\/tr><\/tbody><\/table>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section style=\"font-weight: 300 !important;\" width=\"229\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">El patr\u00f3n debe:<\/span><\/p><ul><li><span style=\"font-weight: 300 !important;\">pagar en las fechas establecidas (plazo semanal, catorcenal o quincenal)<\/span><\/li><\/ul><ul><li><span style=\"font-weight: 300 !important;\">no omitir el pago<\/span><\/li><\/ul><ul><li>pagarlo en moneda nacional, est\u00e1 prohibido utilizar vales, mercanc\u00edas o moneda extranjera.\u00a0<span style=\"font-weight: 300 !important;\">Est\u00e1 permitido realizarlo a trav\u00e9s de transferencia electr\u00f3nica bancaria, y<\/span><\/li><\/ul><ul><li>proporcionarlo al trabajador directamente, salvo que exista alguna imposibilidad para que lo reciba, en cuyo caso, un tercero podr\u00e1 hacerlo.\u00a0<span style=\"font-weight: 300 !important;\">Para tales efectos este \u00faltimo debe presentar una carta poder firmada por el propio colaborador y dos testigos<\/span><\/li><\/ul><\/td><td style=\"font-weight: 300 !important;\" width=\"203\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Multa de 50 a 5,000 VUMA, la cual equivalente de $ 4,344.00 a\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span style=\"font-weight: 300 !important;\">\u00a0$ 434,400.00 pesos.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">De emitirse recibos de pago con una cuant\u00eda mayor al salario realmente cubierto, la autoridad laboral puede imponer una multa de 800 a 3,200 VUMA, importe q<\/span><span style=\"font-weight: 300 !important;\">ue asciende de $ 69,504.00 a $ 278,016.00 pesos.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Tal acci\u00f3n puede configurar un delito sancionable con prisi\u00f3n de seis meses a cuatro a\u00f1os, adem\u00e1s de la multa referida<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"239\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Est\u00e1 prohibido que se paguen salarios inferiores a los m\u00ednimos generales vigentes y el relativo a la Zona Libre de la Frontera Norte (ZLFN)<sup>1<\/sup>.<\/span><\/p><p style=\"font-weight: 300;\">\u00a0<\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Recomendaci\u00f3n:<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">No existe el deber patronal de efectuar aumentos anuales a los salarios de los trabajadores, \u00fanicamente cuando perciban los salarios m\u00ednimos general, de la ZLFN, profesionales, o cuando por contrato individual o colectivo de trabajo se hubiesen obligado a hacerlo<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">\u00a0<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">La parte patronal puede otorgar esta prestaci\u00f3n de forma superior a los establecidos en la LFT, esa cantidad debe considerarse por todo el tiempo que dure la relaci\u00f3n laboral o podr\u00e1 incrementarlo, m\u00e1s no disminuirlo, toda vez que en materia laboral la costumbre es fuente de obligaci\u00f3n, por lo que una vez otorgado de forma superior a lo establecido en la LFT, su observancia ser\u00e1 forzosa.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">En la pr\u00e1ctica los patrones pagan a los subordinados conceptos como el aguinaldo con el salario cuota diaria; no obstante los tribunales laborales han establecido que debe considerarse el salario integrado, compuesto por los elementos indicados en el numeral 84 de la LFT.
