reformas propuestas por el ejecutivo, mismas que se publicaron oficialmente<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-a842a3a elementor-section-stretched elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"a842a3a\" data-element_type=\"section\" data-e-type=\"section\" class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Con la finalidad de \u201cmejorar\u201c la calidad de vida de los trabajadores, as\u00ed como el retiro de aquellos, el presidente Andr\u00e9s Manuel L\u00f3pez Obrador, present\u00f3 diversas iniciativas al Congreso de la Uni\u00f3n las cuales se aprobaron y publicaron en el DOF del 16 de diciembre de 2020.<\/p>\n<p>Los documentos dados a conocer son los siguientes:<\/p>\n\n<ul>\n \t<li>Decreto por el que se reforman, adicionan y derogan diversas disposiciones de la Ley del Seguro Social y de la Ley de los Sistemas de Ahorro para el Retiro, el cual entrar\u00e1 en vigor en lo general el\u00a0<em>1o. de enero de 2021<\/em><\/li>\n<\/ul>\n<ul>\n \t<li>Decreto por el que se reforma el art\u00edculo 37 de la Ley del Instituto del Fondo Nacional de la Vivienda para los Trabajadores, vigente el\u00a0<em>17 de diciembre de 2020,\u00a0<\/em>y<\/li>\n<\/ul>\n<ul>\n \t<li>Decreto por el que se reforman y adicionan diversas disposiciones de la Ley del Instituto del Fondo Nacional de la Vivienda para los Trabajadores y de la Ley del Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado, en vigor el\u00a0<em>17 de diciembre de 2020<\/em><\/li>\n<\/ul>\n<p>\u00a0\u00a0A continuaci\u00f3n se dan a conocer los detalles m\u00e1s 2023,<\/strong><\/b>\u00a0de tal suerte que en 2031 queden las primas a aplicar al salario base de cotizaci\u00f3n (SBC) de los trabajadores como a continuaci\u00f3n se criterios de elegibilidad<\/em>\u00a0<em>a partir de la entrada en vigor del presente decreto<\/em>, son contar con 60 a\u00f1os o m\u00e1s y tener 750 semanas de cotizaci\u00f3n, las cuales aumentar\u00e1n 25 cada a\u00f1o, hasta llegar a 1, 000 en 2031, para acceder a las pensi\u00f3nes por CEAV o m\u00ednima garantizada.<br \/>En el c\u00f3mputo de las semanas de cotizaci\u00f3n y el promedio del SBC se considerar\u00e1n las que los trabajadores tengan registrados en el Instituto de Seguridad y Servicios Sociales de los Trabajadores del Estado (ISSSTE), en los t\u00e9rminos del convenio de portabilidad de derechos con el IMSS<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5fb110a elementor-widget elementor-widget-heading\" data-id=\"5fb110a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Ley de los Sistemas de Ahorro para el Retiro (LSAR)\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2f4106a elementor-widget elementor-widget-text-editor\" data-id=\"2f4106a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Las comisiones que cobren las Afore estar\u00e1n sujetas a un m\u00e1ximo, el cual resultar\u00e1 del promedio aritm\u00e9tico de los cobros en materia de comisiones en los sistemas de contribuci\u00f3n definida de los Estados Unidos de Am\u00e9rica, Colombia y Chile, de conformidad con las pol\u00edticas y criterios que al efecto emita la Junta de Gobierno de la Comisi\u00f3n Nacional del Sistema de Ahorro para el Retiro. En la medida en que las comisiones en estos pa\u00edses tengan ajustes a la baja ser\u00e1n aplicables las mismas reducciones y, en caso contrario, se mantendr\u00e1 el promedio que al momento se est\u00e9 aplicando.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e1426d elementor-widget elementor-widget-heading\" data-id=\"1e1426d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Ley del Infonavit\n\n\n\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d11599 elementor-widget elementor-widget-text-editor\" data-id=\"9d11599\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n \t<li><em>Adquisici\u00f3n de terreno,\u00a0<\/em>el sistema de financiamiento del Infonavit permitir\u00e1 a los trabajadores obtener un cr\u00e9dito barato y suficiente para adquirir, construir, reparar, ampliar o mejorar sus casas y adem\u00e1s para adquirir en propiedad, suelo destinado para sus viviendas.\nEn el caso de que el empr\u00e9stito se use para adquirir un terreno que sea destinado para construcci\u00f3n, reparaci\u00f3n o ampliaci\u00f3n de vivienda, se tiene que acreditar fehacientemente que el latifundio se destinar\u00e1 para fines habitacionales. En donde el Instituto\u00a0debe verificar tal circunstancia, de acuerdo con la normatividad urbana, ecol\u00f3gica, as\u00ed como los instrumentos de riesgos vigentes.\nAdem\u00e1s, previamente a ejercer el cr\u00e9dito de vivienda, el asegurado debe recibir la informaci\u00f3n suficiente sobre las condiciones jur\u00eddicas y financieras del mismo; adem\u00e1s a debe percibir directamente y sin intermediarios el cr\u00e9dito mencionado, siempre y cuando cumpla con los requisitos que al efecto establezca el Consejo de Administraci\u00f3n mediante las reglas de car\u00e1cter general<\/li>\n<\/ul>\n<ul>\n \t<li><em>nuevo financiamiento<\/em>, el trabajador tiene derecho, una vez liquidado su pr\u00e9stamo, a otros cr\u00e9ditos por parte del Infonavit en coparticipaci\u00f3n con entidades financieras. En estos subsecuentes empr\u00e9stitos, podr\u00eda disponer de los recursos acumulados en la subcuenta de vivienda y su capacidad crediticia estar\u00eda determinada de acuerdo con lo que establezcan las reglas, y<\/li>\n \t<li><em>p\u00e9rdida de recursos de vivienda,\u00a0<\/em>cuando no se hubiese ejercido el derecho a recibir los recursos de la subcuenta de vivienda en el entero de una pensi\u00f3n o su entrega, una vez transcurridos los 10 a\u00f1os de que sean exigibles, se sujetar\u00e1 a lo siguiente:<\/li>\n \t<li>\n<ul>\n \t<li>dentro del a\u00f1o previo al que se cumpla el plazo de 10 a\u00f1os, el Infonavit har\u00e1 del conocimiento al asegurado o beneficiario, un aviso sobre el tiempo que ha transcurrido desde que el derecho era exigible, de tal forma que pueda acudir a reclamar dichos recursos, por cualquier medio que determine el Instituto<\/li>\n \t<li>de forma independiente a la notificaci\u00f3n, en caso de que hubiesen transcurrido los 10 a\u00f1os sin que el subordinado o en su caso, los beneficiarios ejercieran su derecho a recibir los recursos descritos, el Instituto los utilizar\u00e1 para constituir una reserva financiera que ser\u00e1 administrada por \u00e9l, y<\/li>\n \t<li>el trabajador y sus beneficiarios pueden acceder al mecanismo de reclamaci\u00f3n de forma permanente, y de ser procedente, el Instituto reconocer\u00e1 los montos a pagar, considerando los intereses que correspondan en t\u00e9rminos de los lineamientos, la suficiencia de la reserva financiera, debe ser dictaminada de forma anual, por un tercero independiente, designado por el Consejo de Administraci\u00f3n del Instituto<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>\u00a0Se recomienda la lectura del tema\u00a0<b><strong>Qu\u00e9 prev\u00e9 la propuesta del ejecutivo sobre la reforma pensionaria<\/strong><\/b>, as\u00ed como la secci\u00f3n de seguridad social de nuestra edici\u00f3n electr\u00f3nica 478 del 15 de enero de 2021, a efectos de observar de qu\u00e9 va la reforma en materia de vivienda.<\/p>\n<p>Si bien estas enmiendas pretenden que un mayor n\u00famero de trabajadores se beneficien con una pensi\u00f3n digan y decorosa; los ajustes son insuficientes porque la cuant\u00eda a recibir por los pensionados no cubrir\u00eda del todo las necesidades que se tienen al momento de retirarse y temerarias porque el incremento de las cuotas patronales en el ramo de CEAV, aunque sea paulatino, y comience hasta el 2023 implicar\u00e1 costos econ\u00f3micos importantes para los empresarios.<\/p>\n<p>Falta ver si en el transcurso del tiempo no conlleva la reforma pensionaria a una mayor informalidad, derivado de que en la actualidad algunas de las empresas omiten el aseguramiento de sus subordinados o lo hacen con un salario inferior al real, justamente por el costo que representa el pago las cuotas obrero-patronales.<\/p>\n<p>Por otra parte, los cambios en materia de vivienda, son acertados ya que permitir\u00e1n utilizar el pr\u00e9stamo de Infonavit para adquirir en propiedad un terreno, lo que permitir\u00e1 incrementar el patrimonio familiar de los asegurados, el cual tambi\u00e9n se ver\u00e1 beneficiado por que se podr\u00e1n adquirir futuros pr\u00e9stamos una vez liquidado el primero.<\/p>\n<p>No obstante, es indispensable llevar de la mano una mejora en el empleo, por lo que el aumento a los salario m\u00ednimos podr\u00eda contribuir a lograr estos objetivos presidenciales de mejorar la calidad de vida del sector obrero.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
