por ello, a continuaci\u00f3n, se hacen algunas precisiones.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0aaed7 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"f0aaed7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f4f4d11 elementor-widget elementor-widget-heading\" data-id=\"f4f4d11\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Laboralmente<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-19c0087 elementor-widget elementor-widget-text-editor\" data-id=\"19c0087\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 300;\">De conformidad con el numeral 53, fracci\u00f3n II de la LFT, la muerte del colaborador es una causal de terminaci\u00f3n de la relaci\u00f3n laboral sin importar porqu\u00e9 se configura.\u00a0<\/p><p style=\"font-weight: 300;\">Ante su ocurrencia, el patr\u00f3n debe cubrir al beneficiario el finiquito correspondiente (integrado por parte proporcionales de aguinaldo, vacaciones y prima vacacional), adem\u00e1s de los salarios devengados y no pagados, la prima de antig\u00fcedad y cualquier otra prestaci\u00f3n pendiente de pago (arts. 76; 80; 87 y 162, fracc. V, LFT).\u00a0<\/p><p style=\"font-weight: 300;\">Cabe mencionar que\u00a0<em>si la muerte de un colaborador deriva de un riesgo de trabajo<\/em>\u00a0(accidente o enfermedad de trabajo)\u00a0<em>y el patr\u00f3n no lo ten\u00eda dado de alta en el R\u00e9gimen Obligatorio del Seguro Social (ROSS), el omiso adem\u00e1s de las prestaciones mencionadas, tienen que cubrir las siguientes cuant\u00edas,<\/em>\u00a0seg\u00fan lo previsto en los art\u00edculos 500 y 502 de la LFT:<\/p><ul style=\"font-weight: 300;\"><li>dos meses de salario por concepto de gastos funerarios, e<\/li><\/ul><ul style=\"font-weight: 300;\"><li>indemnizaci\u00f3n equivalente al importe de 5,000 d\u00edas de salario<\/li><\/ul><p style=\"font-weight: 300;\">\u00a0\u00a0Lo anterior con independencia de que el Seguro Social le imponga el fincamiento del capital constitutivo correspondiente (arts. 77 y 88, LSS).\u00a0<\/p><p style=\"font-weight: 300;\">A fin de evitar pagos dobles, es vital se\u00f1alar que\u00a0<em>estas cantidades se cubren al beneficiario designado por la autoridad laboral,<\/em>\u00a0hasta ahora esta funci\u00f3n le compete a la Junta de Conciliaci\u00f3n y Arbitraje correspondiente.\u00a0<\/p><p style=\"font-weight: 300;\">Para tal efecto,\u00a0<em>quienes se crean tener car\u00e1cter de beneficiarios del trabajador fallecido deben acudir a la Junta competente para iniciar el procedimiento paraprocesal respectivo.<\/em>\u00a0<\/p><p style=\"font-weight: 300;\">Es conveniente mencionar que lo anterior resulta aplicable aun cuando el trabajador fallecido hubiese manifestado en su contrato laboral o mediante una adenda a aquel, a su beneficiario acreedor del cobro de los salarios y prestaciones devengadas a su muerte, en t\u00e9rminos del numeral 25, fracci\u00f3n X de la LFT.<\/p><p style=\"font-weight: 300;\">\u00a0\u00a0Esto es as\u00ed, porque dicha manifestaci\u00f3n simplemente es una presunci\u00f3n de qui\u00e9nes tienen derecho a recibir el pago de las prestaciones laborales adeudadas, pero a la Junta es quien le corresponde hacer ese se\u00f1alamiento.\u00a0<\/p><p style=\"font-weight: 300;\">No hay que olvidar que para el pago de dichas prestaciones de conformidad con el numeral 516 de la LFT, los beneficiarios cuentan con el t\u00e9rmino de un a\u00f1o a partir de la fecha en que falleci\u00f3 el empleado para poderlas reclamar.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-10130ca elementor-widget elementor-widget-heading\" data-id=\"10130ca\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">En materia de seguridad social\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d5d324 elementor-widget elementor-widget-text-editor\" data-id=\"5d5d324\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 300;\">Independientemente de c\u00f3mo ocurri\u00f3 el fallecimiento del subordinado, el empleador debe comunicar al Seguro Social la baja de este, dentro de los cinco d\u00edas h\u00e1biles siguientes a aquel en que hubiese ocurrido la muerte (arts. 15, fracc. I, LSS y 57, primer p\u00e1rrafo, Reglamento de la Ley del Seguro Social en materia de Afiliaci\u00f3n, Clasificaci\u00f3n de Empresas, Recaudaci\u00f3n y Fiscalizaci\u00f3n \u2014RACERF\u2014).\u00a0<\/p><p style=\"font-weight: 300;\">En este caso el IMSS brinda a los beneficiarios del colaborador ciertos beneficios, siempre y cuando estos re\u00fanan los requisitos previstos en la LSS; a saber:\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-03cd2b5 elementor-widget elementor-widget-text-editor\" data-id=\"03cd2b5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<table style=\"font-weight: 300;\" width=\"849\"><tbody><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" width=\"145\"><p style=\"font-weight: 700 !important;\"><strong style=\"font-weight: 700 !important;\"><span style=\"font-weight: 700 !important;\">Pensi\u00f3n<\/span><\/strong><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 700 !important;\"><strong style=\"font-weight: 700 !important;\"><span style=\"font-weight: 700 !important;\">Contingencia<\/span><\/strong><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><p style=\"font-weight: 700 !important;\"><strong style=\"font-weight: 700 !important;\"><span style=\"font-weight: 700 !important;\">Requisitos<\/span><\/strong><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 700 !important;\"><strong style=\"font-weight: 700 !important;\"><span style=\"font-weight: 700 !important;\">Cuant\u00eda de la pensi\u00f3n<\/span><\/strong><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" rowspan=\"2\" width=\"145\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Viudez<b><strong><sup>1<\/sup><\/strong><\/b>: esposa (o) o concubina (rio)<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">(Arts. 55, fracc. IV; 64, fracc. II; 65; 127, fracc. I; 130 y 131, LSS)<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">P\u00e9rdida del trabajador que sufri\u00f3 un riesgo de trabajo a consecuencia de la prestaci\u00f3n de sus servicios<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><ul><li><span style=\"font-weight: 300 !important;\">Acreditar el lazo familiar, y<\/span><\/li><li><span style=\"font-weight: 300 !important;\">que la muerte derive de un riesgo de trabajo<\/span><\/li><\/ul><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">En caso de que el beneficiario sea viudo o concubinario se requiere que haya dependido econ\u00f3micamente de la asegurada fallecida<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">40 % de la pensi\u00f3n que le hubiese correspondido al pensionado, trat\u00e1ndose de una incapacidad permanente total (IPT)<\/span><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Fallecimiento del trabajador o pensionado por causa ajena al \u00e1mbito laboral (enfermedad general)<br \/>\u2014Ramo de Vida\u2014<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Al momento de muerte el asegurado, este hubiese acreditado por lo menos 150 cotizaciones semanales, o que estuviese disfrutando de una pensi\u00f3n de invalidez, y que su deceso no derive de un riesgo de trabajo<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">90 % de la pensi\u00f3n que le hubiese correspondido al asegurado en caso de invalidez o de la que ven\u00eda disfrutando el pensionado por invalidez<\/span><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" rowspan=\"2\" width=\"145\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Orfandad: hijos<b><strong><sup>2<\/sup><\/strong><\/b><\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">(Arts. 55, fracc. IV; 64, fraccs. III a VI; 127, fracc. II y del 134 al 136, LSS)<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Defunci\u00f3n del trabajador que sufre un riesgo de trabajo a consecuencia de sus servicios<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><ul><li><span style=\"font-weight: 300 !important;\">Acreditar el lazo familiar, y<\/span><\/li><li><span style=\"font-weight: 300 !important;\">que la muerte derive de un riesgo de trabajo<\/span><\/li><\/ul><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Cada uno de los hijos debe recibir un 20 % de la pensi\u00f3n que le hubiese correspondido al pensionado, en caso de una Incapacidad Permanente<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Total (IPT).<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">En doble orfandad es del 30 %<\/span><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Muerte del trabajador o pensionado \u2014Ramo de Vida\u2014<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Al momento de fallecer el asegurado hubiese tenido acreditado por lo menos 150 cotizaciones semanales o que estuviese disfrutando de una pensi\u00f3n de invalidez y que no derive de un riesgo de trabajo<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Cada uno de los hu\u00e9rfanos tiene derecho a un 20 % de la pensi\u00f3n invalidez que el asegurado estuviese gozando al morir, o le hubiese correspondido al pensionado por la invalidez.<\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">En doble orfandad es el 30%<\/span><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" rowspan=\"2\" width=\"145\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Ascendencia: padres<b><strong><sup>3<\/sup><\/strong><\/b><\/span><\/p><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">(Arts. 55, fracc. III y 137, LSS)<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Deceso de un trabajador que sufre un riesgo de trabajo a consecuencia de sus servicios<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><ul><li><span style=\"font-weight: 300 !important;\">Acreditar el lazo familiar, y<\/span><\/li><li><span style=\"font-weight: 300 !important;\">que la muerte derive de un riesgo de trabajo<\/span><\/li><\/ul><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">20 % de la pensi\u00f3n que le hubiese correspondido al pensionado, trat\u00e1ndose de una IPT<\/span><\/p><\/td><\/tr><tr style=\"font-weight: 400 !important;\"><td style=\"font-weight: 300 !important;\" width=\"197\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Fallecimiento del trabajador o pensionado \u2014Ramo de Vida\u2014<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"264\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Al momento de fallecer el asegurado o pensionado hubiese tenido acreditado por lo menos 150 cotizaciones semanales o que disfrutara de una pensi\u00f3n de invalidez, y que no derive de un riesgo de trabajo<\/span><\/p><\/td><td style=\"font-weight: 300 !important;\" width=\"243\"><p style=\"font-weight: 300;\"><span style=\"font-weight: 300 !important;\">Cada uno de los padres tiene derecho a un 20 % de la pensi\u00f3n invalidez que el asegurado estuviese gozando al morir, o le hubiese correspondido al pensionado por la invalidez<\/span><\/p><\/td><\/tr><\/tbody><\/table>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7686c45 elementor-widget elementor-widget-text-editor\" data-id=\"7686c45\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 300;\"><sup><b><strong>Notas:<\/strong><\/b><\/sup><\/p><ol><li style=\"font-weight: 300;\"><sup><b><\/b>El c\u00f3nyuge debe probar el v\u00ednculo matrimonial, y trat\u00e1ndose de concubinato, se tiene que probar la convivencia con el fallecido durante cinco a\u00f1os, o haber concebido hijos, y no contraer nupcias. Es importante considerar que si se ostentan diversas concubinas o concubinarios a ninguno se le otorgar\u00e1 la pensi\u00f3n (art. 84, fraccs. III y IV, LSS)<\/sup><\/li><li style=\"font-weight: 300;\"><sup><b><\/b> Menores a 16 a\u00f1os; y hasta los 25 a\u00f1os, si se encuentran estudiando en un plantel del Sistema Educativo Nacional; o que est\u00e9n incapacitados totalmente para mantenerse por s\u00ed mismos, y si existe recuperaci\u00f3n hasta que se d\u00e9 la misma (art. 84, fraccs. V, VI y VII, LSS)<\/sup><\/li><li style=\"font-weight: 300;\"><b><\/b><sup>Solo procede a falta de viuda o hijos, siempre y cuando hubiesen dependido econ\u00f3micamente del afiliado y prueben su convivencia familiar (art. 84, fraccs. VIII y IX, LSS)<\/sup><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-97a6bec elementor-widget elementor-widget-text-editor\" data-id=\"97a6bec\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"font-weight: 300;\">Tambi\u00e9n estos beneficiarios tienen derecho a recibir las siguientes prerrogativas:<\/p><ul style=\"font-weight: 300;\"><li><em>gastos de funeral<\/em>, por un importe equivalente al monto de dos veces el valor mensual de la Unidad de Medida y Actualizaci\u00f3n (UMA); sin embargo, trat\u00e1ndose del deceso por una causa ajena al trabajo el asegurado debe tener reconocidas cuando menos 12 cotizaciones semanales en los nueve meses anteriores al fallecimiento (art. 64, fracc. I y 104, LSS)<\/li><\/ul><ul style=\"font-weight: 300;\"><li><em>ayuda asistencial a la viuda o viudo<\/em>, cuando por su estado f\u00edsico requiera ineludiblemente lo asista otra persona de manera permanente o continua, hasta el 20 % de la pensi\u00f3n de viudez (art. 140, LSS), y<\/li><\/ul><ul style=\"font-weight: 300;\"><li><em>aguinaldo anual<\/em>\u00a0correspondiente a 15 d\u00edas si la muerte es por un RT e igual o superior a 30 d\u00edas si el deceso es ajeno a una actividad laboral (arts. 64, \u00faltimo p\u00e1rrafo y 142, \u00faltimo p\u00e1rrafo, LSS)\u00a0<\/li><\/ul><p style=\"font-weight: 300;\">Finalmente, es importante indicar que el numeral 301 de la LSS, establece que es inextinguible el derecho al otorgamiento de una pensi\u00f3n, siempre y cuando, el solicitante satisfaga todos y cada uno de los requisitos jur\u00eddicos para gozar de las prestaciones correspondientes.\u00a0<\/p><p style=\"font-weight: 300;\">Como se observa la carga patronal en materia laboral es m\u00ednima, siempre y cuando el patr\u00f3n hubiese asegurado al subordinado al ROSS; de lo contrario, debe cubrir las prestaciones a que tiene derecho el beneficiario, as\u00ed como la indemnizaci\u00f3n y el concepto de gastos funerales respectivos.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-01e7f7c elementor-widget elementor-widget-image\" data-id=\"01e7f7c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\"
