Sin embargo, su uso indebido puede tener consecuencias legales, incluyendo el despido justificado del trabajador.\u200b<\/span><\/p><h2><span style=\"font-weight: 400;\">\u2696\ufe0f Marco Legal en M\u00e9xico<\/span><\/h2><p><span style=\"font-weight: 400;\">De acuerdo con el art\u00edculo 47, fracci\u00f3n II, de la Ley Federal del Trabajo (LFT), el uso excesivo e indebido del tiempo de la jornada laboral o de los recursos de la empresa para fines ajenos a la actividad laboral puede considerarse una falta de probidad, lo que podr\u00eda justificar la rescisi\u00f3n de la relaci\u00f3n laboral sin responsabilidad para el patr\u00f3n.\u200b<\/span><\/p><h2><span style=\"font-weight: 400;\">\ud83d\udee1\ufe0f Requisitos para un Despido Justificado<\/span><\/h2><p><span style=\"font-weight: 400;\">Para que el despido sea considerado justificado, el empleador debe:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Establecer Pol\u00edticas Claras<\/b><span style=\"font-weight: 400;\">: Implementar y comunicar pol\u00edticas que restrinjan el uso de herramientas tecnol\u00f3gicas para fines personales durante el horario laboral.\u200b<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Notificar al Trabajador<\/b><span style=\"font-weight: 400;\">: Informar al empleado sobre estas pol\u00edticas a trav\u00e9s del contrato de trabajo, reglamento interior o comunicados oficiales.\u200b<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recabar Evidencias<\/b><span style=\"font-weight: 400;\">: Obtener pruebas del uso indebido, como registros de acceso, monitoreo autorizado o auditor\u00edas internas.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Permitir la Defensa del Trabajador<\/b><span style=\"font-weight: 400;\">: Notificar al empleado de la falta y brindarle la oportunidad de presentar pruebas en su defensa.\u200b<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Cumplir con el Debido Proceso<\/b><span style=\"font-weight: 400;\">: Realizar la rescisi\u00f3n conforme al procedimiento establecido en el art\u00edculo 47 de la LFT.\u200b<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><\/ul><h2><span style=\"font-weight: 400;\">\ud83d\udcdd Proceso de Rescisi\u00f3n Laboral<\/span><\/h2><p><span style=\"font-weight: 400;\">El patr\u00f3n debe entregar al trabajador un aviso escrito que detalle las conductas que motivan la rescisi\u00f3n y las fechas en que se cometieron. Si el empleado se niega a recibirlo, el patr\u00f3n debe solicitar al Tribunal Laboral competente que lo notifique en el domicilio registrado del trabajador dentro de los cinco d\u00edas h\u00e1biles siguientes. El incumplimiento de este procedimiento puede presumir un despido injustificado, salvo que el patr\u00f3n acredite lo contrario en juicio.<\/span><\/p><h2><span style=\"font-weight: 400;\">\ud83d\udd0d Caso Relevante<\/span><\/h2><p><span style=\"font-weight: 400;\">Un ejemplo ilustrativo es el caso de una trabajadora en Cantabria, Espa\u00f1a, quien fue despedida tras acceder 411 veces a redes sociales durante su jornada laboral en menos de un mes. El Tribunal Superior de Justicia de Cantabria ratific\u00f3 el despido, destacando que la empleada incumpli\u00f3 gravemente las cl\u00e1usulas contractuales que prohib\u00edan el uso de internet para fines personales. La sentencia subray\u00f3 la validez de las pruebas presentadas por la empresa y el cumplimiento del procedimiento disciplinario. \u200b<\/span><\/p><h2><span style=\"font-weight: 400;\">\u2705 Conclusi\u00f3n<\/span><\/h2><p><span style=\"font-weight: 400;\">El uso indebido de redes sociales en el trabajo puede ser motivo de despido justificado si el empleador cumple con los requisitos legales establecidos. Es fundamental que las empresas implementen pol\u00edticas claras y que los trabajadores est\u00e9n conscientes de las consecuencias de sus acciones durante la jornada
