class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">La rescisi\u00f3n de una relaci\u00f3n laboral en M\u00e9xico es un proceso que, para ser v\u00e1lido, debe cumplir con ciertos requisitos legales. De acuerdo con el art\u00edculo 47 de la Ley Federal del Trabajo (LFT), el empleador puede despedir justificadamente al trabajador si este incurre en alguna de las causales especificadas en la ley. Para ello, es obligatorio que el patr\u00f3n entregue al trabajador un aviso de rescisi\u00f3n por escrito, detallando claramente la conducta que motiv\u00f3 la terminaci\u00f3n del contrato y la fecha en que ocurri\u00f3.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aunque la LFT no exige la realizaci\u00f3n de un procedimiento previo a la rescisi\u00f3n, es fundamental verificar si en la empresa existe un Reglamento Interior de Trabajo (RIT). Si dicho reglamento establece un procedimiento espec\u00edfico para la rescisi\u00f3n, este debe ser seguido rigurosamente. El incumplimiento de este procedimiento interno puede resultar en que, ante una demanda por despido injustificado, las autoridades laborales fallen a favor del trabajador, obligando al empleador a pagar indemnizaciones o a reinstalar al empleado en su puesto.<\/span><\/p>\n<p><strong>Por lo tanto, es esencial que las empresas:<\/strong><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">Revisen y, en su caso, actualicen su RIT para asegurarse de que los procedimientos de rescisi\u00f3n est\u00e9n claramente definidos y sean congruentes con la LFT.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<li><span style=\"font-weight: 400;\">Capaciten a su personal directivo y de recursos humanos en la correcta aplicaci\u00f3n de estos procedimientos, garantizando el cumplimiento de las normativas internas y legales.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<li><span style=\"font-weight: 400;\">Documenten minuciosamente cualquier incidente que pueda constituir una causal de rescisi\u00f3n, incluyendo evidencias y testimonios que respalden la decisi\u00f3n.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Al seguir estas recomendaciones, las empresas no solo cumplen con sus obligaciones legales, sino que tambi\u00e9n fortalecen su posici\u00f3n en caso de disputas laborales,
